Coaching Session Agreement

 

This agreement is between Meliors Simms, director/coach of Holistic Tooth Fairy Limited, (I/me)

 

and _________________ (you/the client)

 

Holistic Tooth Fairy Ltd (HTF) is offering you a single coaching session in accordance with the terms of this agreement.

By accepting these terms, you (‘the client’) personally agree to be bound by the terms of this agreement.

Holistic Tooth Fairy Ltd Responsibilities

As your coach, I take responsibility for providing up-to-date educational resources, research and information to the best of my abilities. However, I make no promises regarding the accuracy, relevance or quality of the content or the methods used in coaching sessions.

 

Holistic Tooth Fairy Ltd, and Meliors Simms, are not responsible for the health outcomes that clients do or do not experience.

 

Results are not guaranteed. Results may (and do) vary as we are all individuals, and our bodies respond differently to different techniques.

Client Responsibilities

Indemnity You accept and agree that the outcome you experience is beyond the scope of my responsibility, and you are choosing HTF coaching at your own risk

 

If you have any concerns at all about the appropriateness of a particular course of action, if you are in pain, or if there is any other circumstance that worries you, it is your responsibility to immediately seek advice from a properly qualified dental professional.

 

You retain full responsibility for your actions.

 

Non-competition You may not use any of the materials provided as part of your coaching session or follow up emails, or any other material created or owned by the Holistic Tooth Fairy Limited or Meliors Simms, in any manner that infringes any of my rights or that has not been authorised by me.

 

GST New Zealand residents must ensure they pay GST on any coaching service as the Holistic Tooth Fairy Ltd is located in New Zealand and registered for New Zealand Goods and Services Tax (GST).

Your coaching session

Coaching takes place online through Zoom. The Zoom details for your coaching sessions will be provided in your booking confirmation and reminder emails. To access the correct Zoom room, click on the link in your email at the appointed time.

 

If you need to reschedule any of your sessions, you must provide 24 hours’ notice by using the rescheduling link or sending an email so I can schedule another client into that timeslot.

 

Please be aware that if less than 24 hours’ notice is provided, the session will be considered as forfeit and no refund or reschedule will be allowed. Exceptions may be made at the HTF’s discretion, in outstanding circumstances only. For example, if you are unwell or have an emergency and realise you cannot attend your session within 24 hours, please notify me as soon as possible so we can reschedule.  If you repeatedly request to reschedule with less than 24 hours’ notice, your session may be forfeited at my discretion.

 

If you forget about a scheduled session, the session is forfeit.  To reduce the risk of this happening I send three reminder emails between 48 hours and 1 hour prior to the session.

 

If I am unwell or have an emergency that means I will be unable to deliver your session, I will notify you as soon as possible to reschedule.

 

If you are late, the session will still conclude at the designated finishing time.

I will wait for 15 minutes and attempt to contact you with a reminder before I will consider a session to be unattended and, consequently, forfeit.

 

Internet interruptions If my internet cuts out during a session, I will try to call you via phone or an alternative video call service to continue the session. If the session is unable to continue, we will reschedule the remainder of the session for a future day.

Similarly, if your internet drops out, I will message you to continue by phone or another video call service. If your session cannot be on an alternative platform, you can reschedule the remainder of the session for another day.

 

However, please be aware that if this happens more than once, after the first time you will forfeit the subsequent sessions that cannot be completed. It is your responsibility to ensure that you have a reliable method of contact to allow us to work effectively together.

 

Call recordings I may record your coaching session, with your permission which you can withdraw at any time. During a coaching call you may request to record the call on your own device or request access to my call recording. If you request access to my recording, your most recent call recording will be made available in a private Google Drive folder for you to download for two weeks before it is deleted. No recordings can be made available after two weeks have passed since the coaching call. I’m not responsible for any technical problems with the recording or access to the recording.

 

Payment                       

All coaching sessions must be paid for in full prior to the delivery of the session.

 

Online payments are accepted via PayPal or Stripe.  We keep no personal records of customer credit card details.  Credit card details are entered directly into the payment platforms and immediately encrypted for client security.  The last 4 digits are made available for the client to distinguish which card has been used for payment, but no other details are available due to encryption.  If you have any concerns, please consult the security policies of the relevant payment platform.

Refunds Policy           

 

Please choose carefully before you purchase a coaching session as Holistic Tooth Fairy Limited does not offer refunds for change of mind. If your circumstances have significantly changed since you signed up and you find that the timing is no longer right for you may cancel your session provided you give more than 24 hours’ notice.

 

If you cancel more than 24 hours before your session a $30 administration fee will be deducted from your refund

 

If you cancel less than 24 hours before your session there is no refund

 

On request, your prepaid session may be transferred to a friend or family member.

 

If for any reason, I cannot fulfil my commitment to provide the coaching session you have purchased within the timeframe agreed or renegotiated, I will issue you with a full refund for your unused session.

Privacy

Your personal details, x-rays or treatment plans will never be shared outside of HTF without your explicit consent.

 

Your contact details will never be shared outside of HTF.

Intellectual Property

The recommendations provided in coaching are tailored to your specific needs and circumstances, for your own personal use and use with your immediate family.

 

If you wish to share Holistic Tooth Fairy resources on social media, you may only share posts, blogs, videos, audios that the Holistic Tooth Fairy has published for public consumption.

 

You may not use the information received in any commercial activity, including any form of coaching, healing or teaching.

 

The recommendations and unpublished resources delivered in coaching sessions and coach’s emails including documents, emails, videos, photographs, or audio recordings are for your private, non-commercial use only and are not to be shared, published or sold and must not be shared publicly without written permission from the Holistic Tooth Fairy Ltd.

The Holistic Tooth Fairy retains copyright of all published and unpublished information shared in coaching sessions and emails, including the right to be identified as the author of the work, and the right to control how it can be published, shared or sold.

Coaching Disclaimer

This disclaimer relates to the Holistic Teeth Fairy coaching service, which includes the provision of education, advice and support regarding diet, exercise, hygiene; information about the risks and alternatives for different dental interventions; and information about alternative and complementary therapies to support dental health.

The purpose of Holistic Teeth Health coaching is to educate adults about alternative and complementary approaches that support effective self care of teeth and gums and encourage an active, aware alliance with dentists and other health professionals who provide them with dental health services.

When choosing to act on information and advice that Holistic Tooth Fairy coaches provide, you need to consider your other health issues and personal circumstances. It is very important that you do your own research to confirm whether acting on this advice is appropriate for you. You agree to take full responsibility for your own health and well-being.

While some people may experience immediate or speedy improvement of their dental problems after starting to practice holistic strategies, this is not true in all cases. There are many factors to take into account which can reduce the effectiveness of a specific course of action.

My ability to provide information and advice most appropriate for you and your needs depends on you not withholding information about your health and dental history, past and present lifestyle etc.

It is important to take a baseline measurement of your current dental health before starting any of the actions. You should regularly assess changes in your teeth and gums.  This can be with photographs, dental x-rays, measurements, color charts and pH testing.

If your teeth and gum health deteriorate, or pain persists you should seek advice from a dentist or a doctor.  Holistic Teeth Fairy coaching is not a substitute for seeing a dentist, dental hygienist or a doctor.

I cannot guarantee that you will achieve the results that you desire, and it can be dangerous for you to self-treat or ignore serious oral infections.

 

Dispute Resolution

  • We may not respond to you immediately. It may take up to 72 hours to reply to your message.
    • Negotiation
  • If you have any issues or complaints arising out of your coaching session or this agreement, you and Holistic Tooth Fairy Ltd agree to make a genuine effort to resolve the dispute through negotiation and discussion.
  • All information exchanged during our meetings or any subsequent dispute resolution process, shall be regarded as “without prejudice” communications for the purpose of settlement negotiations and shall be treated as confidential by all involved, unless otherwise required by law. However, evidence that is independently admissible or discoverable shall not be rendered inadmissible or non-discoverable by virtue of its use during the dispute resolution process.

 

  • Alternative Dispute Resolution
  • If we are unable to resolve a dispute by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an accredited mediator who is neutral and independent. The mediator is to be appointed by agreement between us; or failing agreement within 21 days of the first notification of the dispute by a person appointed by Arbitrators’ and Mediators’ Institute of New Zealand: http://www.aminz.org.nz/ (AMINZ)
  • The Arbitrators’ and Mediators’ Institute Mediation Rules shall apply to the mediation.
  • We agree to share the costs of mediation equally between us.
    • Litigation
  • Litigation is to be considered a last resort and may not be commenced until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.
    • Mutual Non-Disparagement
  • Both parties agree to act in good faith and communicate disagreements out of the public eye. We will avoid any behaviour or communication which might reasonably be expected to interfere with the business and/or personal interests of the other.
